Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the FireGuard monitoring service — including the website, web dashboard, gateway hardware integration, and Android app (the “Service”) — provided by IoT Soft (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

FireGuard provides real-time monitoring, logging, and alerting for connected equipment such as fire pumps, pressure lines, water tanks, panels, and other sensors, via internet-connected gateways. The Service is a monitoring and notification aid; it is not a substitute for statutory fire-safety systems, certified alarms, on-site inspection, or human supervision.

2. Accounts

• You must provide accurate information and keep your credentials confidential.
• You are responsible for all activity under your account and for the users you invite and their permissions.
• You must be authorised to install and monitor the equipment you connect to the Service.

3. Free trial & subscription

• New accounts include a 3-month free trial from the date of sign-up.
• After the trial, continued use requires an active subscription, billed per connected device on an annual basis. Applicable pricing will be shared on request and confirmed before any charge.
• If a subscription is not activated after the trial, access may be limited or suspended. Historical data may be retained for a grace period and then removed.
• Fees are exclusive of taxes unless stated otherwise. Subscription fees are non-refundable except where required by law.

4. Hardware

Gateway hardware supplied or recommended for use with the Service remains subject to its own warranty terms. You are responsible for correct installation, power, connectivity, and maintenance of on-site equipment.

5. Acceptable use

• Do not misuse the Service, attempt to disrupt or gain unauthorised access, reverse-engineer it, or use it to violate any law or third-party rights.
• Do not connect devices you are not authorised to monitor.

6. Notifications

The Service may send alerts by SMS, email, and push notification. Delivery depends on third-party networks (mobile carriers, internet, Google Firebase) and device settings, and cannot be guaranteed to be instant or uninterrupted. You should not rely on a single channel for life-safety-critical decisions.

7. Availability

We aim for high availability but do not guarantee the Service will be uninterrupted or error-free. We may perform maintenance, updates, or changes, and may suspend the Service where necessary to protect it or its users.

8. Intellectual property

The Service, software, and branding are owned by IoT Soft and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service per these Terms. Your monitoring data remains yours; you grant us the rights needed to operate the Service for you.

9. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the Service will detect every condition or prevent any incident, loss, or damage.

10. Limitation of liability

To the maximum extent permitted by law, IoT Soft shall not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill, arising from the use of or inability to use the Service. Our total aggregate liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Termination

You may stop using the Service and request account deletion at any time. We may suspend or terminate access for breach of these Terms or non-payment. Sections that by nature should survive termination will do so.

12. Governing law

These Terms are governed by the laws of India, and disputes are subject to the exclusive jurisdiction of the competent courts in India.

13. Changes

We may update these Terms from time to time. Continued use after changes take effect constitutes acceptance of the revised Terms.
